Terms of Service
These Terms of Service ("Terms") govern your access to and use of the VolyaVPN application and related services (the "Service") provided by VolyaVPN ("VolyaVPN", "we", "us", or "our"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of terms
By creating an account or using the Service, you confirm that you accept these Terms and that you have the legal capacity to enter into this agreement. These Terms incorporate our Privacy Policy by reference.
2. Description of the Service
VolyaVPN is a virtual private network service for Android that encrypts your connection and routes it through servers in multiple locations, including the United States and Ukraine. Features, server locations, and availability may change over time.
3. Accounts and eligibility
You may create an account using an email address and password or by signing in with Google. You are responsible for keeping your credentials secure and for all activity that occurs under your account. Notify us promptly of any unauthorized use. You must be at least 16 years old, or the age of digital consent in your jurisdiction, to use the Service.
4. Acceptable use
You agree to use the Service lawfully and responsibly. You will not:
- Use the Service for any illegal activity or to facilitate unlawful conduct.
- Infringe the intellectual property or other rights of others, including through unauthorized distribution of copyrighted material.
- Attack, disrupt, overload, or attempt to gain unauthorized access to any network, system, or account, or send spam or malware.
- Resell, sublicense, or commercially redistribute access to the Service without our written permission.
- Circumvent usage limits, or share, transfer, or misuse your account.
5. Device and usage limits
Your account may be subject to limits on the number of simultaneous devices or connections, depending on your plan. We use connection timestamps to enforce these limits fairly across users.
6. Abuse detection and enforcement
To protect our network and other users, we operate automated measures to detect abuse, including activity associated with prohibited or infringing use. Where such activity is detected, we may flag, throttle, suspend, or block the responsible account, with or without prior notice, at our discretion. Repeated or serious violations may result in permanent termination.
7. Service availability
The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or available at any particular speed or in any particular location, and we may modify, suspend, or discontinue any part of the Service at any time.
8. Disclaimers and limitation of liability
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, VolyaVPN will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service.
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Provisions that by their nature should survive termination will survive.
10. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date below. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
11. Governing law
These Terms are governed by applicable law without regard to conflict-of-laws principles. Any disputes will be resolved in the competent courts of the jurisdiction in which VolyaVPN operates, unless mandatory local law provides otherwise.
